Posting of Real Property

Under Arkansas law, it is unlawful to enter posted private property without written permission from the owner or lessee. Specific rules apply to how land may be posted and what materials may be used.

Arkansas Law on Trespassing

Arkansas Code Annotated § 18-11-403(a)(2): “It shall be unlawful for any person to enter upon any real property posted under the provisions of this subchapter without the written consent of the owner or lessee of the real property.”

ACA § 18-11-406(a)(2): Anyone who knowingly paints the prescribed posting color on trees or posts for purposes other than posting real property is guilty of a Class B misdemeanor.

ACA § 18-11-406(b): It is also unlawful to post property not owned or leased by the person without written permission from the owner or lessee. Violators are guilty of a Class B misdemeanor.

Note: The Forestry Division prescribes the type and color of posting paint but does not enforce trespassing or posting laws.

What Land Can Be Posted?

  • Forests
  • Orchards
  • Pastures
  • Impoundments
  • Cultivated land
  • Other real property

Who Can Post Property?

  • The owner of the land
  • A lessee with legal rights to the property

How to Post Property in Arkansas

Forest Land

Signs:

  • “POSTED” or “NO TRESPASSING” in at least 4-inch-high letters
  • Placed at each road entrance and no more than 100 feet apart
  • Clearly visible to approaching persons

Paint:

  • Vertical purple paint marks at least 8 inches long
  • Placed on trees or posts no more than 100 feet apart, and at each road entrance
  • Positioned 3 to 5 feet from the ground and clearly visible

Cultivated Land, Orchards, Pastures, Impoundments, and Other Property

  • Same as above, but signs or paint marks may be up to 1,000 feet apart

Posting Paint Requirements

The official posting paint is a purple, semi-paste, tree-marking paint. It must meet or exceed these specifications:

Solid Pigments (Base color) – 62.6%

  • Titanium Dioxide – 22.2%
  • Calcium Carbonate – 77.8% 

Vehicle (varies with manufacturer) – 37.4%

  •     Oleoresinus Vehicle – 47.2%
  •     Petroleum Solvents – 45.4%
  •     Driers, wetting agents, and tinting materials (lamp black, red iron oxide, magenta) – 7.4%
